NATHANIEL R. JONES, Circuit Judge. Defendant-Appellant Jeffrey Thomas Whaley appeals the admission into evidence of a statement he gave to law enforcement officials without an attorney present. The statement, in part a confession, led to his jury conviction on counts of possessing a firearm in relation to a drug crime and of possessing an illegal shotgun. We reverse the conviction and hold that the officials violated Edwards v. Arizona, 451 U.S. 477, 68 L. Ed. 2d 378, 101 S. Ct. 1880 (1981), by interrogating Whaley even though he had previously declined to talk without an attorney present. Because we reverse the conviction under Edwards, we do not address Whaleys more general argument that the confession was inadmissible as the product of coercion, nor do we address the United States cross-appeal challenging the length of the sentence imposed.
